The group who organized the recent petition asking the RSFA Board to investigate whether the Silvergate assisted living project conforms to the Protective Covenant’s zoning and land use laws, is asking the Board to respond to their third petition calling for a special meeting and/or member vote of all Covenant members. Ranch resident, Courtney Svajian, in a letter sent to the Board on Monday, asked Directors to respond to their petition which has been signed by more than 335 members and growing.
The Board will be meeting at 10 am, Thursday, December 5, at the Avenida de Acacias office. The topic of the petition was not added to the regular agenda, but will likely be discussed in private executive session ahead of the December 5 petition response deadline. Davis-Stirling laws prohibit a quorum of HOA Board members to make Association decisions in a closed meeting, other than to address personnel or legal matters.
Board decisions made in a non-quorum executive session, which included only the Board president, vice president, treasurer and Association manager, were among the complaints in a previous lawsuit brought by a former Board director who alleged that Board decisions were made in secret without the knowledge of the other directors or membership at large, violating Davis-Stirling laws and PC governance norms.
